Swerving, Open Wine Bottle
1st Offense - Not Guilty After Trial
Client was stopped for swerving across marked lanes "several times." Cop noted a "strong" odor of alcohol, slurred speech and an open bottle of wine in the center console and several beer cans in the car. At trial, attorney Dunn argued that the client stood normally, no swaying, walked normally, no stumbling, and spoke normally, no slurring. Thus, no evidence that client was impaired by alcohol. The judge agreed - Not Guilty!
