At jury trial, attorney Dunn argued that client's speech was normal, not slurred, and he walked normal, no staggering. Client also completed the alphabet test perfectly and did well on the balancing tests. Jury agreed there simply wasn't enough and found client not guilty. Attorney Dunn then immediately filed a motion to reverse the 3-year breath test refusal suspension.
