Not Guilty - First Offense

Client involved in an accident. When police arrived, they said he was unsteady on his feet and there was a "strong" odor of alcohol, admission to having "two Heineken's" and slurred speech. After arrest, client failed the breath test at the station. At trial, attorney Dunn kept the breath test out and played booking video that showed the client walking, standing and speaking completely normally. He argued there was a disconnect between what the police testified to about unsteadiness and what the judge saw in the video. The judge agreed and found him not guilty.
